Bennett Cove Case in Limbo

The case against Cecil F. Bennett, Jr., concerning activity at his property called Bennett Cove on Hwy. 212 west was transferred to Superior Court, as Dr. Bennett requested a jury trial.

The case was set to be arraigned in Magistrate Court on August 5, however his attorney asked for a jury trial prior to that.

Now, the case has been sent back to Magistrate Court because it is a county code violation and not a state code violation, and Superior Court does not hear county code violations.

The case is now set to be arraigned on September 9 in Magistrate Court.

Dr. Bennett is charged with violation of county code 8-1, occupation tax required for business; code 8-9 transacting business when tax delinquent, and 8-14, transacting business without registration obtained.
