Grand Jury Returns Indictments

On Tuesday, Dec. 3, a Grand Jury indicted Chelsey Guthrie on six counts including homicide by vehicle in the second degree (a misdemeanor charge), motor vehicle keeping safe distance from bicycle, duty to avoid distractions (two counts), improper passing of vehicle proceeding in the same direction and following too close.

The indictment came after the state presented evidence to the Grand Jury concerning an incident that occurred August 12, 2013, on Aikenton Road, which resulted in the death of Herschel Lee Richard.

The presentment to the grand jury was labeled a “special presentment,” meaning no warrant has been taken in the case.

Fifteen other True Bills were returned by the Grand Jury, which were all concerning drug related charges, as follows:

Christopher Head—possession of methamphetamine with intent to distribute, possession of methamphetamine and possession of marijuana less than one ounce.

Michael A. Livers—manufacturing marijuana, possession of marijuana, possession of methamphetamine and obstruction of an officer.

Jacob L. Holland—sale of methamphetamine.

Thomas Bert Line—sale of marijuana (two counts), possession of marijuana with intent to distribute and possession of marijuana with intent to distribute within 1,000 feet of a public school.

Lamon Ann Clemons—sale of schedule III controlled substance.

Chad Taylor—possession of a controlled substance with intent to distribute (two counts).

Michael La’Malcom Johnson—burglary in the first degree, theft by receiving stolen property, possession of marijuana less than one ounce and obstruction of an officer.

Richard L. Rodriguez—possession of marijuana with intent to distribute and possession of marijuana.

Bart Wesley Ray and Heather Gail Rutledge—possession of methamphetamine and possession of drug related objects.

William Harris Anderson—sale of methamphetamine (two counts).

Mathew Bryan Jackson—sale of methamphetamine (two counts).

Alvin Glenn Yates—sale of marijuana.

Rodriquez Deonta McGuire—sale of marijuana.

Jackie Whiten Reagin and Wayne Ellis Mask—possession of methamphetamine with intent to distribute, possession of methamphetamine, possession of marijuana less than one ounce. An additional charge of driving without a license was found against Ms. Reagin only.

Quan Dameon Middlebrooks—possession of a controlled substance with intent to distribute, obstruction of an officer and open container.

Two other True Bills were returned which were not drug related, as follows:

Jamie Leanne Blackmon—fleeing or attempting to elude a police officer (two counts), reckless driving, driving while license revoked, hit and run, obstruction of an officer, failure to maintain lane, speeding, failure to stop at stop sign and habitual violator.

Tiffany Lynn Kidd—obstruction of an officer (two counts), driving under the influence of alcohol less safe, endangering a child while driving under the influence, reckless conduct.

An indictment by a Grand Jury is not an indication of guilt, but rather that sufficient evidence was presented to warrant taking a case to trial.
