Revocations Dominate Court
Eight people had their probation revoked during a Jasper County Superior Court Criminal Motion Day Tuesday.
Sufficient evidence was presented to satisfy the Court, presided over by Judge William A. Prior, that the defendants had violated the terms and conditions of their probation, with details as indicated below:
•Horace Horton—committed the new offenses of obstruction, fleeing or attempting to elude, driving while license suspended or revoked, giving false information, DUI, alteration of license plates. Mr. Horton, originally convicted of two counts of possession of cocaine and possession with intent in June of 2001, was placed on Intensive Parole for 12 months and upon completion return to regular probation.

•Aaron Michaels—committed the new offense of failure to report and pay court ordered monies. Mr. Michaels, originally convicted of burglary in 2002, had his probation suspended upon entry into a state detention center for 60/90 days and upon release return to regular probation.
•Dennis Dewayne Lewallen—committed the new offense of failure to report and pay court ordered monies. Mr. Lewallen, originally convicted of violation of the Georgia controlled substance act, was ordered to spend 90 days in the Jasper County Jail, suspended upon entry into a state detention center for 90/120 days and upon completion return to regular probation.
•Joshua Paul Eason—committed the new offense of possession of marijuana, and also tested positive for marijuana use on April 9, 2009. Mr. Eason, originally convicted of three counts of criminal damage to property, was ordered to be placed on Intensive Probation for 12 months and upon completion return to regular probation.
•Shane Douglas Herrin—committed the new offense of battery and cruelty to children in the third degree. Mr. Herrin, originally convicted of aggravated assault in May 2005, was ordered to be placed on Intensive Probation and upon completion be returned to regular probation.
•Obie Lucky—committed the new offenses of aggravated assault and battery, and also had pled guilty to criminal damage to property, theft by taking, obstruction of an officer and driving while license suspended. Mr Lucky, originally convicted of probation revocation was ordered to serve two years in the state penal system and upon release return to regular probation.
•Randy Pitts—pled guilty to the new offense of possession of a firearm by a convicted felon, giving false information, and also failed to report to the Jasper County Jail for transport to the detention center as per order of his sentence. Mr. Pitts, originally convicted of burglary, theft by taking and theft by receiving in November of 2008, was ordered to serve two years in the state penal system and terminate probation.
Also, the probation revocation case versus Charles Gotel was continued, and the petition of probation revocation of David Harold Robertson was withdrawn. In one last case, the motion to modify the sentence of Yogi Andrew Yeomans was also continued.
