Mannings File Rezoning Appeal

Robert and Nannette Manning have filed an appeal against Jasper County and the Jasper County Board of Commissioners in Jasper Superior Court.

The document is an “Appeal and verified complaint for declaratory judgment, mandamus, and injunction.” The document seeks to allow the placement of a convenience store at the intersection of Hwy. 11 south and Perimeter Road.

The Jasper County Commission voted against the rezoning required for the convenience store after Planning & Zoning had recommended approval.
The lot is a .99 acre lot of record. The subject property is currently zoned agricultural, and the lot is too small to build a home, and the plaintiffs maintain they should be able to place a convenience store there.

The document requests a declaratory judgment allowing the rezoning. In addition, the suit alleges that the portion of the zoning ordinance which provides that findings of fact by the Board of commissioners may not be appealed is unconstitutional.

The appeal was filed in Jasper Superior Court Tuesday.
