Probation Violation Results in Jail Time
Daniel Kipp Smith, who was on probation from November, 2010 for four counts of felony obstruction of an officer, misdemeanor obstruction, giving false information, driving under the influence of alcohol or drugs, possession of marijuana less than one ounce and driving while license suspended, was back in court on May 21, with Judge E. Trenton Brown, III, presiding.
The court found sufficient evidence to determine that Mr. Smith had violated the terms of his probation by the new charge of failure to report. He was sentenced to serve 60 days in the county jail with credit for time served, and upon release complete 60 hours of community service while being returned to active probation supervision.
Also, Jesse James Gude, who was on probation for various convictions, was found to have violated the conditions of his probation by the new offense of testing positive for alcohol. Mr. Gude was sentenced to serve 60 days in the county jail with credit for time served and upon release to participate in outpatient alcohol and drug treatment while remaining on active probation supervision.

A third offender, Xazavin Deronte Jackson, who was on probation for conviction of the charge of possession of marijuana less than one ounce, was found to have violated his probation via the new charges of failure to report since July 2011, and testing positive for THC and marijuana. Mr. Jackson was sentenced to serve 90 days in the county jail and upon release his case terminated.
One other criminal case was continued, two civil cases were settled, one was taken under advisement and another was rescheduled for June 11, 2013.
